2.刑法上指犯 罪行为人对于他所实施的危害社会的行为和结果的心理态度。参见〔故意犯罪〕

3.民法上指过 错的一种形式。即义务人明知其行为将侵害他人的权利而希望或放任这种结果的发生。应负赔偿的责任。
