为了使国家、公共利益、本人或他人的人身、财产和其他权利免受正在进行的不法侵害，而采取的制止不法侵害的行为。正当防卫对不法侵害人造成损害的，不负刑事责任。应具备的条件：（1）必须是对不法侵害的行为；（2）必须是对正在进行并且实际存在的不法侵害；（3）只能对不法侵害者本人；（4）防卫不能超过必要限度。
