由非职业审判人员参与协助法庭审理案件的制度。起源于古代雅典和罗马，12世纪盛行于英国。有大陪审团和小陪审团，适用于英美法系。与中国的人民陪审员不同，中国的人民陪审员是合议庭组成成员方式之一。
