对被判处有期徒刑和无期徒刑的犯罪分子，在执行一定刑期后，确有悔改表现，不致再危害社会，予以附条件提前释放的制度。适用条件是有期徒刑执行原判刑期二分之一以上，无期徒刑执行刑期十年以上。对累犯以及杀人、爆炸、抢劫、强奸、绑架等暴力性犯罪，被判处十年以上有期徒刑或无期徒刑的不得假释。假释考验期内没有发现应当撤销假释的法定情况，期满就认为原判刑罚已经执行完毕；如果又犯新罪或发现漏罪，则撤销假释，按数罪并罚处理。

1. 法律用语。对服徒刑未满的罪犯，确有悔改表现、不致再危害社会的暂予释放的措施。假释期间，如不再犯罪，就认为原判刑罚已经执行完毕。否则，便将前后所判处的刑罚合并执行。
