当事人在合同 中约定的一方向对方给付的具有债权担保作用的货币。表现在给付方不履行债务的，无权要求返还；收受方不履行债务的，应当双倍返还。其数额由当事人约定，但不得超过主合同标的额的20%，债务人履行 债务后，应抵作价款或收回。
