世界上的全部海洋，除分别属于各沿海国家的内海、领海和国家管辖范围以内的海域外，都是公海。公海不受任何国家主权的管辖，各国有平等使用公海的权利。

1. 指沿海国管辖范围(包括领海、专属经济区和大陆架)以外的广大海域。有些发展中国家主张以“国际海域”(即国家管辖范围以外的海域)代替“公海”这一名称。公海(或国际海域)及其资源原则上应当为世界各国所共有，应当在平等互利的基础上由各国共同管理、合理使用。
